The video sequence, including previously unseen images from inside the restaurant, opened a pivotal hearing in Mangione’s bid to exclude evidence from his upcoming state murder trial. Prosecutors say a 9 mm handgun found in Mangione’s backpack matches the weapon used in the 4 December 2024 attack. Thompson was shot from behind while walking to a corporate investor conference near his Manhattan hotel.

Mangione, 27, watched intently, fingers pressed beneath his chin, as officers approached him over breakfast in Altoona, Pennsylvania, nearly 230 miles from New York. At moments he clenched a pen as prosecutors played a 911 call made by a McDonald’s manager. The caller relayed customer concerns that Mangione resembled the suspect and described how his beanie and medical mask left only his eyebrows visible.

Detention under constant supervision

Before being flown to New York, Mangione was isolated in a monitored housing unit at a Pennsylvania state prison. A correctional officer testified that officials separated Mangione to prevent information leaks, noting the superintendent’s comment that the facility “did not want an Epstein style situation,” referring to Jeffrey Epstein’s 2019 death in federal custody.

Among the items Mangione’s defence team wants barred are the handgun and a notebook prosecutors claim outlines plans to “wack” a health insurance executive. Both were seized from the backpack he carried during his arrest.

Mangione, an Ivy League educated member of a wealthy Maryland family, has pleaded not guilty to state and federal murder charges. He faces a possible life sentence in state court while federal prosecutors are seeking the death penalty. Neither case has a trial date. The next federal hearing is set for 9 January.

Defence challenges searches, statements

After persuading a judge to dismiss state terrorism charges in September, Mangione’s lawyers are now targeting what they label unconstitutional police actions.

They argue prosecutors should not present the gun, notebook or other seized items to jurors because officers lacked a search warrant when they inspected the backpack. The defence is also attempting to suppress statements they say were taken before Mangione was advised of his rights, including his alleged claim that his name was “Mark Rosario.” Prosecutors counter that Mangione used the same alias when checking into a Manhattan hostel days earlier.

The defence further wants to exclude remarks Mangione made between his arrest and his transfer to New York on 19 December. A corrections officer testified that Mangione spoke about travelling in Asia, witnessing a gang fight in Thailand, and comparing private versus nationalised healthcare systems. Mangione allegedly asked whether media coverage focused more on him or the crime and suggested he wanted to make a public statement.

Another officer said Mangione spontaneously mentioned that his backpack contained foreign currency and a 3D printed pistol, prompting visible disbelief from defence attorney Marc Agnifilo.

Prosecutors say evidence points to motive

Surveillance video presented in court showed the masked gunman shooting Thompson from behind. Prosecutors say ammunition recovered from the backpack was marked with the words “delay,” “deny” and “depose,” echoing criticism of how insurers deny claims.

Removing the gun and notebook would severely weaken the case, prosecutors argue, calling the items crucial links to motive. Court filings detail excerpts from Mangione’s writings, including alleged admiration for Ted Kaczynski and musings about rebelling against “the deadly, greed fueled health insurance cartel.” In one passage, prosecutors say, Mangione wrote that killing an industry figure “conveys a greedy bastard that had it coming.”

Body camera footage captured an officer saying she was searching the backpack to ensure there “wasn’t a bomb,” an explanation the defence calls a pretext to mask a warrantless search. Federal prosecutors counter in separate filings that officers were justified in checking the bag for safety reasons and that Mangione’s statements were voluntary and made before he was formally arrested.

Hearing expected to run more than a week

Court officials expect the hearing to extend past Thursday, the one year anniversary of Thompson’s death. Prosecutors have signalled plans to call more than two dozen witnesses.

Mangione appeared in court in a grey suit and checked shirt rather than a jail uniform. Officers removed his handcuffs so he could take notes.

NYPD Sgt Chris McLaughlin testified about efforts to share surveillance stills with media outlets in the days after the shooting. Prosecutors played multiple clips, including Central Park divers searching a pond and Fox News broadcasts showing police distributed suspect images.

Several Mangione supporters attended, including one man in a green shirt bearing the slogan “Without a warrant, it’s not a search, it’s a violation.” Another woman held a Luigi video game doll with a miniature version clipped to her purse.
